TERMS OF SERVICE ​

1. INTRODUCTION AND ACCEPTANCE OF TERMS ​

1.1. Service Overview ​

Sukon Discord Bot ("Sukon Bot", "we", "our", "service") is a multi-functional Discord bot developed to provide entertainment, server management, and music services for the Discord community. The bot is developed by FoobAB0510 and inspired by Shirakami Fubuki - a VTuber from Hololive. Sukonbu is the community name and Sukon is the member name.

1.2. Acceptance of Terms ​

By adding Sukon Bot to your Discord server or using any functionality of the bot, you agree to comply with all terms and conditions set forth in this document. If you do not agree with any terms, please stop using the service immediately.

1.3. Eligible Users ​

  • The service is for users aged 13 and above
  • Users under 18 need parental consent and supervision
  • Must comply with Discord's Terms of Service

1.4. Scope of Application ​

This agreement applies to:

  • Using the bot in Discord servers
  • Accessing web dashboard (if available)
  • Interaction with APIs and related services
  • All forms of Sukon Bot service usage

2. SERVICE DESCRIPTION ​

2.1. Music Features ​

  • Multi-platform Music Playback: SoundCloud, Deezer, Source, Spotify (metadata)
  • Queue Management: Add, remove, sort, shuffle songs
  • Audio Filters: 15+ audio effects (Nightcore, Bass boost, Vaporwave, etc.)
  • Loop Modes: Loop song, loop queue, autoplay
  • Personal Playlists: Save and manage personal playlists
  • Advanced Controls: Seek, pause, resume, volume adjustment

2.2. Server Management ​

  • Moderation: Ban, kick, mute, voice channel management
  • Automation: Auto-reply, counting system, AFK system
  • Server Backup: Backup and restore server configuration
  • Temporary Channels: Auto-create and delete voice channels on demand
  • System Logging: Record important activities
  • Flexible Settings: Customize prefix, language, command permissions

2.3. Entertainment and Utilities ​

  • Anime/Manga Search: Information from public APIs
  • Mini Games: Counting, trivia, and other games
  • User Utilities: Avatar, server info, Wikipedia, Google
  • AFK System: Away status notifications
  • Multi-language: Support for Vietnamese and English

2.4. Technical Services ​

  • High Uptime: Auto-recovery system when errors occur
  • API Endpoints: For third-party applications
  • Webhook Support: Integration with other services

3. USER RIGHTS AND RESPONSIBILITIES ​

3.1. User Rights ​

  • Free use of all basic bot functions
  • Request technical support through official channels
  • Contribute feedback for service improvement
  • Request personal data deletion according to legal regulations
  • Report bugs and security issues

3.2. User Responsibilities ​

  • Legal Compliance: Do not use bot for illegal purposes
  • Respect Copyright: Do not play copyrighted music without permission
  • No Spam: Do not abuse bot commands causing system overload
  • Appropriate Content: Do not use bot to share harmful content
  • Security: Protect login information and do not share sensitive data

3.3. Prohibited Behaviors ​

Users are NOT allowed to:

  • Use bot to distribute pornographic, violent, or hate-inciting content
  • Attempt to hack, reverse engineer, or attack the system
  • Use multiple accounts to bypass rate limiting

3.4. Consequences of Violation ​

Violations may result in:

  • Warning and request to stop violating behavior
  • Blacklist from bot system
  • Report to Discord Trust & Safety
  • Legal action if necessary

4. OUR RIGHTS AND RESPONSIBILITIES ​

4.1. Our Rights ​

  • Modify Service: Update, modify, or discontinue providing functions
  • Refuse Service: Ban usage for violation cases
  • Data Collection: According to published Privacy Policy
  • Legal Cooperation: Provide information when requested by authorities
  • Monitoring: Monitor usage to ensure compliance with terms

4.2. Our Responsibilities ​

  • Provide Service: Ensure bot operates stably and reliably
  • Security: Protect user data according to security standards
  • Support: Provide basic technical support
  • Transparency: Notify about important changes
  • Legal Compliance: Operate according to Vietnamese law

4.3. Limitation of Liability ​

We are NOT responsible for:

  • Indirect Damages: Data loss, profit loss, or business opportunities
  • User Behavior: Content created or shared by users
  • Third-party Services: Errors from Discord, SoundCloud, Spotify, etc.
  • Force Majeure: Natural disasters, war, pandemic, or events beyond our control
  • Copyright Content: User copyright violations

Liability Disclaimer:

  • Community Representative: Although inspired by Sukonbu, Sukon Bot does NOT represent any other related department or organization, created by an individual for entertainment and learning purposes

4.4. Insurance and Compensation ​

  • Maximum total compensation: 0 VND (free services)
  • Users agree to compensate us if usage violates law
  • Service provided "as is" without warranty

5. INTELLECTUAL PROPERTY AND COPYRIGHT ​

5.1. Our Ownership Rights ​

  • Source Code: All code and algorithms of the bot

5.2. Usage License ​

We grant users:

  • Non-exclusive, non-transferable license
  • Rights to use bot for personal
  • License may be revoked upon terms violation

5.3. User Content ​

  • Ownership: Users retain ownership of their content
  • Usage License: Users grant us rights to use content for service provision
  • Responsibility: Users are responsible for the legality of their content

5.4. DMCA and Copyright Complaints ​

  • Complies with Digital Millennium Copyright Act (DMCA)
  • Provides copyright violation reporting mechanism
  • Processes complaints within 48 business hours
  • Cooperates with copyright owners to resolve disputes

6. THIRD-PARTY SERVICES ​

6.1. Service Integration ​

Sukon Bot integrates with the following services:

  • Discord API: Core platform for operation
  • SoundCloud: Music search and playback
  • Spotify: Song metadata retrieval (no direct playback)
  • MongoDB Atlas: Data storage
  • Redis Labs: Cache and session management
  • Google APIs: Web search, translate, etc.

6.2. Third-party Terms ​

  • Users must comply with terms of each third-party service
  • We do not control third-party policies or operations
  • Third-party changes may affect bot functionality

6.3. Responsibility and Risks ​

  • We are not responsible for errors from third-party services
  • Third-party service discontinuation may disrupt functionality
  • Data may be shared according to third-party policies

7. PAYMENT AND REFUNDS ​

7.1. Free Service ​

  • All basic bot functions are provided free of charge
  • No payment information required for usage
  • No hidden fees or unexpected charges

7.2. Donations ​

  • Users may voluntarily donate to support the project
  • Donations do not provide special privileges
  • No commitment to refund donations

8. SECURITY AND PRIVACY ​

8.1. Privacy Policy Reference ​

Details regarding data collection, usage, and protection are specified in a separate Privacy Policy, which is an integral part of these terms.

8.2. Security Commitment ​

  • Use SSL/TLS encryption for all connections
  • Store data on reliable platforms
  • Perform regular backups
  • Limit data access permissions

8.3. Security Incident Reporting ​

  • Notify users within 72 hours
  • Cooperate with higher authorities when necessary
  • Implement immediate remedial measures

9. SERVICE TERMINATION ​

9.1. Termination by Users ​

Users may:

  • Remove bot from server at any time
  • Request deletion of personal data
  • Stop using without prior notice

9.2. Termination by Us ​

We have the right to terminate service when:

  • Users violate terms of service
  • Required by law enforcement
  • Necessary to protect system and other users
  • Discontinuing service provision (7-day advance notice)

9.3. Consequences of Termination ​

  • Loss of access to all bot functions
  • Data may be deleted according to retention policy
  • All commitments and warranties will terminate
  • Some terms remain in effect (security, intellectual property)

10. DISPUTE RESOLUTION ​

10.1. Good Faith Negotiation ​

  • Prioritize dispute resolution through dialogue
  • Contact via official Discord server for support
  • Response time: 72 business hours
  • Provide evidence and detailed information about disputes

10.2. Mediation ​

If negotiation is unsuccessful:

  • Use third-party mediation services
  • Mediation costs split equally
  • Mediation decisions are binding

10.3. Competent Court ​

  • Disputes resolved in Vietnamese courts
  • Vietnamese law applies
  • Language of proceedings: Vietnamese
  • Ho Chi Minh City Courts have jurisdiction

10.4. Arbitration ​

  • Parties may agree to resolve through arbitration
  • Comply with Vietnamese arbitration rules
  • Arbitration decisions are final and binding

11. OTHER TERMS ​

11.1. Applicable Law ​

These terms are governed by:

  • Laws of the Socialist Republic of Vietnam
  • E-commerce Law 2005
  • Consumer Rights Protection Law 2010
  • Network Information Security Law 2015
  • Other related legal documents

11.2. Severability ​

  • If one term is declared invalid, other terms remain effective
  • Invalid terms will be replaced with equivalent legal provisions
  • Does not affect the integrity of the entire agreement

11.3. Assignment ​

  • Users may not assign rights and obligations
  • We may assign with 30-day advance notice
  • Assignment does not affect user rights

11.4. Notices ​

  • Official notices via Discord server or bot announcements
  • Email only used for serious legal matters
  • Notices effective 24 hours after posting

11.5. Waiver ​

  • Non-enforcement of a term does not mean waiving rights
  • We may enforce rights at any time
  • Waivers must be made in writing

11.6. Entire Agreement ​

  • These terms plus Privacy Policy constitute the entire agreement
  • Replaces all previous agreements
  • Can only be modified through official procedures

12.3. Bug Reports and Feedback ​

  • Use #help-or-report form channel in Discord server or use /bug-report command in Sukon bot
  • Provide detailed information about bugs
  • Screenshots and log files if possible
  • Suggest improvements and new features

12.4. Community ​

  • Join Discord server to connect with community
  • Share experiences and usage tips
  • Contribute to building a positive community
  • Follow community rules
